Outline and Evaluate Issues Surrounding the Classification and Diagnosis of Depression

Outline and Evaluate Issues Surrounding the Classification and Diagnosis of Depression Scheff’s Labelling Theory is a process which involves labelling people with mental disorders when they produce behaviour that does not fit with socially constructed norms and labelling those who reflect stereotyped or stigmatized behaviour of the ‘mentally ill’. A disadvantage of labelling an individual with depression is that labelling can accentuate and prolong the issue. In addition by labelling someone with depression who in fact is not depressed may in fact become depressed as a result.Another problem is that labelling an individual with depression means that they can have problems with getting a job and leading a life in the future because they are not treated as a normal person. Thus labelling has a large effect on individuals with depression. On the other hand labelling a person with depression means that they are enabled to seek help and find treatment for themselves. A lthough labels are stigmatizing, they can also lead those who bear them down the road to proper treatment and recovery.Another issue surrounding the diagnosis and classification is that there are different types of depression outlined in the different classification manuals. Sometimes clinicians are unable to distinguish between different types accept unipolar and bipolar. However, research has shown that 10% of people diagnosed with Major Depressive Disorder (MDD) develop bipolar episodes later. The same was found with dysthymic disorder which can develop in MDD later; this is known as double depression and is found in 25% of depressed patients.Other diagnostic tool is the Beck Depression Inventory This is a 21 item self-report questionnaire designed to measure the severity of symptoms in individuals diagnosed with depression. Each question is designed to assess a specific symptom common in people with depression for example the sense of failure, self-dislike, social withdrawal or suicidal ideas. Items 1 to 14 assess symptoms that are psychological in nature for example feelings of sadness. Items 15 to 21 then assess more physical symptoms for example the loss of energy and irritability. Each item is accompanied by four alternative responses, graded for severity and scored from 0 to 3. The implications of using different diagnostic tools on the classification and diagnosis of depression are that reliability of diagnosing depression may be affected. Just as with physical medical disorders mental illness diagnoses are also not always reliable. The practitioner uses mainly symptoms that the patient reports rather than physical signs to reach a decision.Moods often vary over time in most people and this can have implications when testing reliability. As well as different types, there are different subtypes of depression that are recognised in the manuals and clinicians have had to distinguish between the causes of depression in order to distinguish between the sub types. For example they distinguish between endogenous depressions which are biologically determined and reactive depressions which are determined by biological stressors.Even though distinctions between these two causes of depression are not conclusive, there is a reliable cluster of symptoms which can help differentiate between types of depression. For example, the endogenous types of depression usually have more severe symptoms and higher suicide rates. Another problem arises with the diagnostic criteria for children, even though depression can remain undiagnosed in children. Children sometimes have other disorders which include behavioural problems and disruptive behaviour; therefore depression may be overlooked in the diagnosis. As well, children tend to show anger, aggressiveness and irritability rather than low mood. Co-morbidity is the incidence of a disorder being coupled with another disorder. Depression can occur with other disorders such as Schizophrenia, eating disorder and alcohol addiction and substance abuse. This makes it difficult in the diagnosis of depression, it leads clinicians to have to determine which the primary disorder, schizophrenia is or depression, eating disorders or depression. There are also issues relating to reliability which may affect the diagnosis. One type is Test-retest reliability, which occurs when a practitioner makes the same consistent diagnosis on separate occasions from the same information. In terms of depression this can be applied if the same Doctor or Psychiatrist gives a patient a diagnosis of depression on two separate occasions. The other is Inter-rater reliability occurs when several practitioners make identical, independent diagnoses of the same patient. This can be applied to depression by confirming that the diagnosis of depression is accurate in a given situation. Issues of validity also arise in the diagnosis of depression. For example, Predictive validity occurs if diagnosis leads to successful treatme nt, then the diagnosis can be seen as valid. Under the heading of depression, there are a series of depressive disorders such as Major Depressive Disorder, Pre-Menstrual Disorder etc. In terms of depression predictive validity will occur if the right diagnosis is made followed by a subsequent correct course of action.Research by Sanchez-Villegas et al (2008) supports the ‘predictive validity’ of depression diagnosis. They assessed the validity of the Structured Clinical Interview to diagnose depression, finding that 74. 2% of those originally diagnosed as depressed had been accurately diagnosed, which suggests thus diagnostic method is valid. Cultural differences may impact an individual with depression because the DSM is used in West to diagnose depression. This criterion is biased towards people in the Western world. What is considered abnormal in one culture may be considered normal in another culture. Thus someone diagnosed in Europe with depression may not have been diagnosed with depression elsewhere. In addition treatment to the disorder can be very different in different cultures. Thus an individual in two different cultures may be treated differently for depression. So therefore despite the universality of the symptoms of depression clinicians must take into account cultural differences in diagnosing depression. For example, patients from non-western cultures tend to complain more of the physical symptoms such as loss of appetite and lack of sleep than personal distress. This is supported by a study done in New York in which 36 South Asian immigrants and 37 European Americans were given vignettes describing depressive symptoms. The Asian immigrants found more social and moral problems which could be dealt with by the individual whereas the Euro-Americans tended to find more biological explanations, that required professional intervention. Culture Adaptation And Cultural Change Essay

Culture refers to the lifestyle or rather a system of tradition that dictates the thought and even action of a given group of people in a society. It gets its expression in the language, beliefs, customs and even food thus offering a direction for effective successful living. Culture gives one identity of the everyday symbols, customs, body language; food and social cues which becomes very difficult to lose overnight. Cultural adaptation is the processes through which an individual undergoes in order to adjust to another culture different from his normal way of life. Different countries or environment have differing cultural practices and its common for people to feel disoriented when they leave their familiar surrounding to a different environment or countries. It is quite true that culture restrains our behavior because it plays a vital role in our day to day lives. Culture socializes us into a given way of life and is responsible for determining who we are and our view of the entire world. Who we are does not only depend on our nature and personality but also the culture that surrounds us. Humans are sum and substances of nature, personality and the culture all of which contributes importantly to the final individuals. Our culture affects how we think, how we behave, who we are and how we respond to our surrounding and it is easily transmitted from generation to generation through the parents, education systems and even peers. Since culture is greatly embedded in our nature and personality, that is, culture is a central ingredient in the production of a human person; it’s a big huddle to adapt to other cultures. However, we are daily confronted with issues that call for modification, recreation and even elimination of some of the elements of our cultures. For effective cultural change to be obtained there is need to understand the underlying differences in the current culture and the culture one wants to create. Our culture is transformed by our daily pressure on what old tradition that needs to be dropped, how to combine the diverse elements of cultures that surrounds us and the daily decision of the new ideas to be included in the culture. Cultural change is possible when we define precisely the culture we are building and use those terms to inflict the necessary changes we want to make in the existing culture. As groups of people migrate from places to come together they tend to merge cultures and finally come up with a common cultural practice for all. The most common element of culture that experience drastic changes is the language especially when the groups are interested in trading with each other, they will need a common mode of communication thus the language would be quickly changed to ease trade. However, there are other elements of culture that cannot be wholly eradicated, such as food preferences and the norms that outlast the reason for their development. For cultural change to be effected all the stakeholders must be willing to change. The social nature in humans that tends to drive them to share their experiences and knowledge with others is another powerful tool in effecting cultural change. Reference: Samuel P. Huntington. Media Imagery Effects on Adolescent Girls Research Paper - 1

Media Imagery Effects on Adolescent Girls - Research Paper Example In the book Everything’s an Argument with Reading, is designed to be a true alternative to the traditional argument (Williams 81). It complements students approach with unique broad examples and therefore responds soundly to reasoning around them. In most cases argument of evaluation provides profound decisions about someone's life through the involvement of certain standards (Williams 83). The particular standard required for an individual is an establishment of judgment within an individual. A person is required to judge anything that comes across his or her life. This judgment can be an idea, a work of art, a person or a product. It is this lack of sound argumentation that can lead to making a relevant judgment that makes girls susceptible to effects that comes from media imagery (Williams 85). According to Nachbar and Lause (119), the examination of these evaluation criteria such as an idea or art of work is enough to give a verdict that they have impounded on the adolescent girls both positively and negatively. The programs that are aired by the media can influence an adolescent girl to make a decision that leads to an explosive behavior to dangers. An adolescent girl may become frightened and violent with others such as suicidal commitment. Lundsford, Ruszkiewicz and Walters (54) assert that in as much as media provides education and entertainment, they can also result in aggressive attitudes and violent behavior. Violence in the media especially those programs that affect the psychological effect on children and women in advertising or merchandising in media are harmful to girls. As a result of self-image seen, they are therefore influenced to behave and try to imitate their behavior.

The impact of the Internet on the field of advertising Essay

The impact of the Internet on the field of advertising - Essay Example This work "The impact of the Internet on the field of advertising" outlines how the increasing usage of the Internet affected advertising industry and tools that it uses. Advertising through internet has made it possible for advertising agencies to measure the impact of their adverts on the potential viewers. This has been done through the development of methods of assessment based on measuring the number of times that individuals either visit a website or the number of clicks that have been made on a particular advert (Lee & Ahn, 2012). In this way, advertising agencies have come to have sound knowledge concerning not only the effectiveness, but also the means of developing improvement to adverts so that they can be more attractive to customers. Furthermore, internet advertising has made it possible for advertising agencies to only pay for those adverts that are performing. A method where payments are made based on the number of times that individuals click on an advert rather than on the impressions of the adverts themselves. This method of payment has attracted a large number of advertisers to the internet because they are able to have value for their money. Advertisers no longer have to worry about paying for nonperforming adverts because the internet has mechanisms to determine whether the adverts that they have posted are worth paying for or not, thus making the internet more efficient. The internet has had an impact on the manner through which investments are conducted by advertisers.

Women Should not be Priest Essay Example | Topics and Well Written Essays - 250 words

Women Should not be Priest - Essay Example The audience for this article includes females and those who support the ordination of women. The author has successfully used various strategies to appeal to the audience. For instance, she has used ethos to support her arguments. The author’s experiences and knowledge about the subject increases the credibility of her arguments. Dr. Susan Ross, who is the author, is a theology professor. This makes the audience to trust her claims. In addition, the author has used logos to strengthen her arguments. For instance, she has stated facts that support the argument. For instance, citing the traditional facts such as Christ being male and the traditional prohibition of female ordination sounds more convincing. Moreover, pathos has also been used in the article. For instance, she has used emotional language that appeals to the audience imagination. She has done this by narrating historical events especially in the bible. This not only makes the audience to respond emotionally but als o to identify themselves with the author’s arguments. However, some of the fallacies make her argument lack validity. For instance, associating traditional roles of a woman in the society with her abilities as a priest lacks soundness. This is because in the current society females are also the bread winners in their

Define the Italian Renaissance. When did it begin and when did it end Essay

Define the Italian Renaissance. When did it begin and when did it end What were the intellectual, cultural, economic, and polit - Essay Example This was embraced by majority of the people from the middle ages. Factors that made the Italian renaissance possible There were political, intellectual, economic and cultural that facilitated the Italian renaissance leading to great achievements. These are discussed below: Political Factor There was political division between the Northern and the upper Central Italy. They were divided into warring states. There were also two opposing parties namely Guelfs and Ghibellines which operated within each state. Stronger states gathered enough forces and captured smaller states. During the renaissance period, Italy was governed through a series of oligarchies. These were ruled by specific families like the Borgia and the Medici families which were wealthy. These families supported the renaissance. For example, the Medici family was able to fund the thinkers of that time3. During the late 15th century, the ruling class and the aristocracy fully adopted the Renaissance ideal. This made it easy for its philosophy and art to spread faster. Under the rule of Cosimo de' Medici, the son of Giovanni de' Medici, the town of Florence became stable and prosperous. This motivated people to support the idea of development instead of fixing their minds to the influence of the Catholic Church. Political philosophers like Niccolo Machiavelli influenced renaissance through their works. Niccolo wrote articles like Florentine Histories and The Prince and Discourses on Livy. The Prince and Discourses on Livy had much more influence than any other piece of writing at the time. It led to a change in political perspective of many people. Niccolo wanted people to view politics from the point of reality and absolutism. The families which ruled used the renaissance as their power. The renaissance got to its peak in the 16th century. There were foreign invasions in Italy which led to the turmoil of Italian wars. It led to great devastation of northern Italy and loss of independence of many state s. In May, 1527, Spanish and German troops invaded Italy. It was as a result of this invasion that Rome encountered major setbacks for two decades. This brought to an end the role of the Papacy as a driver of Renaissance4. There were shifts in the control of the Papacy. Renaissance philosophy and art dominated the Vatican when wealthy families like the Borgias and Medici began controlling the Papacy. Intellectual The stage for renaissance was set by the Italian literature revolution in the 13th century. Before renaissance, Latin, French and Provencal were used as the literary languages in Italy instead of the Italian language. Come the 13th century, Italian authors began producing their works using their native language. Mid 13th century poets like Giuttone d'Arezzo and Giodo Guinizelli pioneered poetry works like Dolce Stil Novo which means Sweet New Style. This poetry work stressed on platonic rather than courtly love. Aldus Manutius initiated book printing. This led to an increas e in books published in the Italian language. Italian writers were able to produce many new books about sports, science, farming and politics. At the same time, there were many texts written in Greek and Latin. These had great contributions to the Italian renaissance. A lot of study and translation was conducted to the Greek and Latin texts. Science and philosophy was also developing. This influenced the poetry and literature of the renaissance. Italy had great philosophers, artists, sculptors

Researched Drama Paper (Hamlet) Research Proposal

Researched Drama Paper (Hamlet) - Research Proposal Example The Shakespeares were a prosperous and locally prominent family. His father, John Shakespeare, was a successful businessman. A great deal is known of Stratford which enables us to understand something of Shakespeare’s boyhood there. The town supported a grammar school which was free to the sons of Burgesses of whom Shakespeare was one. He also went to Grammar school. It is not known what Shakespeare did between the time he left school and his departure for London. Some stories about him that he got into trouble for poaching deer – are possible, but unproved. He married Ann Hathaway, daughter of a yeoman farmer. Their first child was Susan and later, twins, Hamnet and Judith. Very soon after the latter’s birth, Shakespeare departed for London without his family. Shakespeare entered the theater as an actor and was to be an actor-manager for the rest of his life. He made money also as a playwright. Shakespeare died in Stratford in 1616 at the unbelievably early age of 52. Shakespeare wrote the following plays in a period of eight and nine years. Julius Ceasar; Hamelt; All’s Well that Ends Well; Troilus and Cressida; Measure for Measure; Othello; King Lear; Macbeth; Antony and Cleopatra; Timon of Athens; Corionalus. Hamlet has been adjudged the best of men and the worst of men. Mark van Doren in his introduction to the play states that something in his personality renders him superior to decision and incapable of acting. His antic disposition has been analyzed as both a sign of abnormality as well as a device for seeming to be mad. One judgment is as good as another. Very little can be said that will be untrue of this brilliant and abounding young man. Opinions have differed as to which other character can best bring out Hamlet’s character to the fore. Many writers would probably choose Horatio, his close friend and ally who supports Hamlet throughout the story, who echoes his way of thinking and is all praises for him. For

Research Methods - Essay Example Twin studies are particularly suited to separate the environmental and genetic backgrounds of an abundance of traits such as intelligence, schizophrenia and alcohol dependence (Winerman 2004). In trying to determine whether genetics plays a role in intelligence both intelligence quotient (IQ) test and MRI Scans. The brains of about ten identical twins and ten fraternal twins could be scanned. Since identical twins have identical genes, tests for correlation should show close to 100% for identical twins while tests for and fraternal twins would show correlation closer to 50% since they are not likely to have identical genes. In terms of schizophrenia a number of identical twins are tested for the disease. If both identical twins carry the disease they are concordant. If they do not then they are discordant. The rate of concordance determines whether the disease is hereditary Schizophrenia.com (n.d.). According to About.com (n.d.), in terms of alcoholism twin studies would compare the incidence of alcoholism of identical twins with that in fraternal twins. If there is any genetic component in the risk of alcoholism then identical twins with identical genes are be expected to show similar histories of either developing alcoholism or not developing alcoholism. Fraternal twins, on the other hand, who are genetically different individuals, are more likely to differ in their tendencies as it relates to alcoholism. Motluk, A (2001). Quality of Life Assignment Example | Topics and Well Written Essays - 750 words

Quality of Life - Assignment Example Diabetes commonly referred to as a diabetes mellitus is a group of biological metabolic diseases associated with blood pressure, frequent urination, increased hunger and increased thirst. If not checked and managed early, can lead to many other complications such as cardiovascular disease, kidney failure, stroke among others. The inability of insulin hormone to function normally has adverse effects on the metabolism protein, carbohydrate and fat. This is because insulin encourages storage of protein and fat thus considered an anabolic hormone. A relative insulin deficiency ultimately leads to weight loss, even though; there is an increase in appetite. Some untreated patients of diabetes also complain of fatigue, vomiting and nausea (Peacock, 2000). Patients with diabetes are probable to developing infections of the skin, bladder and vaginal regions. In addition, fluctuations in blood glucose levels can lead to blurred vision. Extremely elevated sugar level can lead to lethargy and coma. Potentially reversible diabetes conditions are such as pre-diabetes — when ones blood sugar levels are higher above normal, but not high enough to be considered as diabetes. The body does not produce insulin hormone. Some people could refer to this type as insulin-dependent condition of diabetes or juvenile diabetes. Individuals normally develop type 1 diabetes just before their 40th year, often in early adulthood or youthful years. There are two known kinds of diabetes type 1 and type 2. Type 1diabetes is nowhere closer as common as type 2 diabetes. About 10% of all diabetes cases are type 1. However, Type 2 starts with insulin resistance; normally cells fail to respond to insulin well. As the condition progresses, deficiency of insulin may also develop. The diabetes complications are biologically related to blood vessel conditions and are normally classified into small vessel conditions or diseases, such as those connecting

Innocence in Catcher in the Rye Essay Example for Free

Innocence in Catcher in the Rye Essay In JD Salinger’s Catcher in the Rye, Holden Caulfield is a boy aimlessly traveling New York City after being expelled from a classy boarding school. Holden poses a great deal of trepidation when it comes to sexual relationships, especially those of Jane and Sunny. Furthermore, Holden tends to misjudge the maturity of his fellow characters. The combination of this misconception, the tension between sexual trepidation, and an adult life with adult relationships, results in confusion for him. In Holden’s life, there have only been a few people he’s cherished more than his childhood neighbor, Jane Gallagher. They were close childhood friends, and when his roommate Stradlater brings her up years later in high school, all he can talk about is the innocent fun they used to have: playing checkers, watching her dance ballet in the summer heat, and how her Doberman always came into his yard. However, he also reminisces on how her â€Å"boozehound† stepfather would always â€Å"run around the goddam house naked† (42). He suspects that her stepfather had harassed Jane, who â€Å"had [a] terrific figure, and [he] wouldn’t’ve put it past that bastard† (103). This really bothers Holden, as does when Stradlater insinuates that he made sexual advances onto Jane on their date. To Holden, sexual encounters mean an adulteration of innocence, and he hates that Stradlater or Jane’s stepfather may have corrupted Jane. Many times, Holden promises himself that he â€Å"outa go down and say hello to her† (40), or that he should â€Å"give old Jane a buzz† (195), but he never does. Subconsciously, he fears that Jane will have grown up, and calling her or seeing her will surely alter the young, innocent, checkers-playing version of Jane that he has in his mind. This is confusing for Holden because Jane has grown up, yet he still thinks of her as a little girl, not the grown woman that she is. Holden â€Å"knew that she wouldn’t let [Stradlater] get to first base with her, but it drove [him] crazy anyway† (104). This shows Holden’s potential misconception of Jane’s innocence. It is unlikely for a post-teenage young woman to be as sheltered and have as much innocence as she did when she was a little girl. However, this is something Holden cannot grasp. This dilemma is a direct result of Holden’s irrational respect for innocence, influenced by sexual confrontations in Holden’s past. When Holden agrees to have a prostitute come to his room in the hotel, he is soon greeted by Sunny at his door. Holden is immediately unimpressed with Sunny’s maturity; how she was â€Å"jiggling this one foot up and down†, she â€Å"never said thank you†, and she â€Å"had this tiny little wheeny-whiny voice† (123). He also notices that she appears very young, and said things that were really childish. This ends up making him feel â€Å"more depressed than sexy† (123), and he decides not to have sex with her after all. The depiction of this young girl making money as a prostitute seems to upset Holden, and he ultimately concludes that having sex with her would spoil her innocence. This is where Holden is again misguided. Just as it is unlikely for Jane to retain the same degree of innocence through the years, it is improbable that Sunny, being a prostitute, will have not had sex with many people in the past, therefore preserving her innocence. But all Holden can see in Sunny is the childish and immature, which results in a conflicted view of the world. The importance of innocence to Holden is something that results in nervousness towards others’ sexual identity and activity. His perspective of Jane and Sunny’s innocence is also misguided to the point where he sees innocence in them when there is none. Overall, the importance of innocence to Holden results in contention that is less than innocent.

Fear of Crime Survey Results

Fear of Crime Survey Results Data The data set used and analysed consisted of results from residents (N=300) who participated in the 2014, Gold Coast Community Survey on fear of crime and the factors that are associated with individual perceptions of what contributes to their fear. The data gathered from the survey analyses groups of categorical variables including fear, demographic characteristics, news and information, as well as community characteristics. Fear and News and information are categorised into their own variables with multiple values, whereas demographic and community characteristics are grouped represented by individual variables and further represented through multiple values. Demographic characteristics include; gender, age, income and education level. Community characteristics include; collective efficiency and Social cohesion. A detailed description of the data set including values is shown in Table 1. In this analysis the primary focus is to determine the association between fear and various othe r factors, thus determining that fear is the categorical dependant variable and the subsequent variables are independent variables. Table 1 Sub-sample size and Frequencies of variables. (N =300) Methods To determine whether there was a connection between fear of crime and various factors that could possibly influence or are associated with each individual’s perceptions, a chi-square r x c test for independence was conducted on the assembled data. This test was chosen to be conducted for this analysis due to all the variables being used are categorical with multiple values. Therefore meeting two assumptions for the chi-square test for independence; all categorical variables (Nominal or Ordinal) and should consist of two or more categorical variables. The other primary assumption of the chi-test for independence, which is the expected frequency should not drop below five in more than 25% of the cells in a contingency table was also met. The results displayed only two (4.55%) cells falling below the expected frequency count of five, with the minimum being 2.08, therefore not contributing to more than 25% cells of the contingency tables. Results A chi-square r x c test for independence was performed to examine the relationship or association between fear of crime and various factors that contributed to each participants perceptions. Within this analysis there were multiple variables to be examined to determine the association with fear of crime, the significant findings will be discussed prior to results table 2. Within the age of participant variable, 48% of participants over the age of 65 were fearful of crime, compared to 2.3% of participants aged between 55 and 64, 4.7% of participants between the ages of 25 and 54 years, and 3.3% of participants aged between 15 and 24 years. The relation between the dependant variable fearful / not fearful and the variable age of participant, showed that there was a significant association (X ² (3, N=300) = 106.59, p ≠¤ .001). The Cramer’s V was 0.59, thus resulting in approximately 35% variance of frequencies of fear can be explained by the variance of age. Within the var iable news and information, 46.7% of participants perceived the television increased fear of crime compared to 3.3% due to the radio, 7.0% due to print, 1.3% due to the internet and 0% due to other sources. The relation between the dependant variable and the variable of news and information, showed that there was also a significant association (X ² (4, N=300) = 59.39, p ≠¤ .001). The Cramer’s V was .445, thus resulting in approximately 20% variance of frequencies of fear can be explained by the variable of news and information. Both the Age variable and the news and information variable showed statistically higher associations with fear of crime, representing factors from demographic characteristics and news and information; compared to alternate variables, particularly community characteristics. Further detailed results of variables shown in table 2. Table 2 Results of chi-square test on variables associated with fear on crime Conclusion The variables age and news and information both have a significant association with the fear of crime within the Gold coast community. Addressing the research questions, the preceding data demonstrates that demographic characteristics and news and information both are related to residents fear of crime thus, concluding that the answers to research question one and two are, true, there is a relation The third research question enquiring the relationship between community characteristics and residents fear of crime, although the data concluded there is a slight relationship, it is not as significant as the other variables. Therefore it is suggested that strategies address the residents fear on crime by focusing on the factor of age and the production of news and information of crime, to alter the perceptions.

Reviewing the American Constitution

Reviewing the American Constitution Ignacio J. Blanco Eminent Domain The development and freedom of a society and its individuals depend to a large extent on the content and protection of property rights. In practically all the legal systems the indemnification to the individuals is consecrated in the event that the State deprives them of their property through an act of expropriation. Being one of the first to recognize such a guarantee, the Fifth Amendment of the United States Constitution prohibits the State from expropriating property for public use, without payment of fair compensation to its owner. The application of such requirement is relatively easy to enforce when the government formally exercises deprivation of property to a private individual, especially when dealing with real estate. The question in this matter is: when should a particular sector of the population bear the cost of a regulation whose benefits are taken advantage by society as a whole? In outlining the concept of eminent domain regulation, a convenient point of departure tu rns out to be the examination of the next argument: the right of the State to exercise eminent domain. When the government needs a certain private property for public use, it should clearly state its intention assessing the specific property, and then paying the former owner a fair compensation. Usually, the main issue in the governments use of eminent domain is what constitutes fair compensation. Eminent domain is defined as: the power that the government has to expropriate a private land for public use (U.S Fifth Amendment). This power is limited by the Federal Constitution as well as State Constitutions when the government takes a private property for common use, it must properly indemnify the owner for the alienation (U.S. Fifth Amendment). Sometimes the exercise of eminent domain consists of a simple process, in which the government grants the owner a fair price and this will result in the appropriation of the property for common use. On other occasions, the government and the owner may disagree as to whether an expropriation needs to occur and what the amount of compensation should be. In these types of cases a legal procedure will be necessary to certify the legitimacy of the expropriation and establish a fair price for the property. The Fifth Amendment expropriation clause protects the owner and assures that he or she will receive appropriate compensation. This clause has three significant components: the first component states that eminent domain should only be applied to private property. Due to this fact, if the government decides to modify the purpose of some public land, for example, to build an office building or a homeless shelter in what used to be a public park, this action will not require government to compensate citizens who used the park. The second requirement is that the land should only be expropriated for common use. This limitation prevents government officials from taking private property for personal use. In this case, this requirement will protect citizens from government officials that might try to get any personal gains from taking private property. Lastly, The Fifth Amendment requires fair compensation. Usually, fair compensation is determined by the market value of the property, in other words. the price at which the owner could have expected to sell the property. It is important to know that the value of the property should be set considering many factors. These factors include: the size of the land and the buildings, the location of the property, the access to utilities and public services, resources present on the property, etc. When a permanent expropriation is about to take place, the courts will use different methods to determine market value. However, if the government needs the property for a limited time, the calculation of value will be more complicated. In cases of eminent domain, the government states that it needs certain private property to create a public benefit, such as the construction of a new stadium or public park. The government can offer the owner a price that is acceptable to the individual or the individual can initiate an expropriation procedure. This procedure is similar to a lawsuit and it is started by the owner of the property when they do not reach agreement. The owner of the property has the right to be notified of the decision of the government and can submit a reply. As one can see, the Fifth Amendment offers protection to the owner and guarantees that he or she will receive a fair compensation for the expropriation. In some non-usual cases the government will deny the claim that they have taken property from the owner. Therefore, the owner would have to initiate an action, denominated procedure of compensation by expropriation, to demand compensation from the government. This situation might occur in various ways. For example, the government may adopt behavior that destroys the owners ability to use and enjoy his or her land, such as building a rail road along the owners property. As one can see, this action does not involve an expropriation, but will certainly reduce the value of the property, forcing the owner to file a lawsuit to obtain compensation. The necessity to determine the time at which the expropriation occurred is important in the matter of eminent domain. An argument may arise when the government presents a plan that affects the property of a citizen. In other words, when the government makes a public announcement about the possibility of starting a new infrastructure project this could potentially impact the value of private property. Furthermore, the owner might think that this plan will already constitute an indirect expropriation, which will could cause stress and uncertainty about the future. Even though the government can claim that they have not taken away any property at this point, its actions have already affected the value for future transactions, causing undesired consequences. The concept of eminent domain gives the government power to act on behalf of public interest. Unfortunately, in many cases, the government violates property rights without offering a fair compensation. The legal issues involved in th ese matters are complex and the courts have not been entirely coherent in their approach. In conclusion, more than two centuries have passed since the proclamation of the American Constitution. However, the constitutional normative body continues to expand its application and renew its validity. The decisions dictated by the courts, offer a variety of interpretations, not always uniform but with an undeniably value. This academic paper offers a summary on how jurisprudence has constructed the concept of eminent domain regulation. According to the government these regulations have no other purpose than to protect citizens from its own government, while trying to draw clear boundaries to delineate its application. The concept of eminent domain goes beyond a simple theoretical construction, it is a true legal institution that articulates basic concepts of private law such as property and economic freedom, in addition to foundational principles of public law like the common good.

A Stranger Is Watching Essay -- essays research papers

A Stranger is Watching A Stranger is Watching is a terrific book. I enjoyed reading this book very much. The non-stop action kept me reading for hours.   Ã‚  Ã‚  Ã‚  Ã‚     Ã‚  Ã‚  Ã‚  Ã‚  One of the best features of the book is how it was written. The point of view changes every chapter. For example Chapter 1 is written in the point of view of the infamous Foxy character. Chapter 2 is written in the point if view of our protagonist, Steve; and so on .I also liked how the author built the relationship of the characters up, so you care about what happens to them and feel like you're going through what they are going through. For instance, the author tells us of Steve's wife's death. We find out that Steve's son, Neil was never the same after this tragedy. When a new women, Sharon comes into Steve's life, Neil rejects her. Neil thinks that if Sharon and his father get married ,his father will send him away. When Neil and Sharon are held hostage together, Neil's feelings for Sharon change; he begins to see her as a nice person and a motherlike figure. I felt the author built this relationship up well so that the story would have a happy ending.  Ã‚     Ã‚  Ã‚     Ã‚  Ã‚  Ã‚  Ã‚     Ã‚  Ã‚  Ã‚  Ã‚  I also like how the author made the character traits of the protagonist completely conflict with the antagonist. Women in Sports - NCAA vs. AIAW :: Sports Essays Women

NCAA vs. AIAW Women have faced an uphill battle throughout the history of sports whether it is to be able to compete in sports, to attain equal funding for programs, to have access to facilities, or a number of other obstacles that have been thrown in their ways. Women have had to organize and administer their own sports structure rather than compete within the men's structure that existed. The sheer strength and determination of many women sports heroes is what propels women's sport to keep going. One theme that has predominantly surfaced in this fight though is the merging of women's programs with men's, oftentimes only when they are successful enough to stand alone on their own. When female athletes wanted to participate in tournaments and intercollegiate play they had to form their own league, since the NCAA would not accept women's teams. Many women fought long and hard in order to form the Association of Intercollegiate Athletics for Women (AIAW) in 1972, and even harder to make it the successful league it eventually became. The AIAW gained corporate sponsors and television coverage of their national championship and also catapulted women's basketball into the forefront of athletics worldwide. In 1976, just four years after the formation of the AIAW, women's basketball debuted at the Olympics. At the end of its reign the AIAW had created 42 national championships and moved from a 276 charter member institution into an organization consisting of 971 institutional members (Hult). In 1979 Title IX was passed, giving female athletes a huge step towards achieving their goals but possibly giving the AIAW it's defeating blow. With the passage of Title IX came funding for women's sports that was not present prior to this. Suddenly women's athletics were more than just a game, they were profitable sports and men took note of this. Most educational institutions merged their men's and women's physical education and athletic departments. Since this new athletic department had twice the staff that was needed, women athletic director and administrators were sent down to secondary positions. Men were now controlling women's athletics, one domain where women had ruled for the past decade. Male coaches weren't the only ones to notice the potential profit included in women's athletics; the NCAA began to make serious offers to AIAW about merging. Because the NCAA had not prior to this considered the AIAW an equal until women's athletics had potential for television contracts and national championships, the AIAW refused these offers.

He Who Laughs Last Laughs Best

Freislyn Santana Revision English 106-112 (College English II) Professor Jaime Gallagher Essay #1- Short Story 11/12/2012 He Who Laughs Last Laughs Best Edgar Allan Poe is an extraordinary writer with many powerful pieces of work, such as The Raven, The fall of the House, and The Tell-Tale Heart. The author’s theme in the story â€Å"The Black Cat† is Overconfidence can betray. In his short story â€Å"The Black Cat† Poe explores the perils of overconfidence. Poe’s use of character, tone, and irony develop this dark tale of arrogance with adventure. To portray his theme, Poe uses the story element â€Å"character† towards the ending of the story, illustrating how the narrator believes there is no way he can be caught. IN the flowing days after the murder, he begins to feel free, happy, and secure. His overconfidence becomes evident when the police unexpectedly come to search his home. He felt no embarrassment nor regret in allowing them inside. He ac companied them in the search in a calm and collected manner. As the police prepare to leave, the narrator describes himself as too happy to contain himself and badly wanted to mention a single word of his triumph. He believes there’s no way he’s going to be caught, and becomes too confident and cocky. His overconfidence leads to his demise. His final act of overconfidence is evident as the police leave, he shows off by brazenly tapping the wall with his cane. The cat cries out from the wall which leads the police to tear down the wall. They find the cat atop the corpse, the same cat the narrator so loathed and believed had ran away. Furthermore, Poe also uses â€Å"tone† as a means to portray his theme. Poe establishes calmness when the police arrive to search the home. The narrator is not in any way nervous or afraid that he might get caught; in fact, he feels secure of his concealment of his wife’s remains. Faced with a police search, the narrator quivere d not a muscle. He says â€Å"His heart beats calmly as that of one who slumbers in innocence. † He invites the police in assists them in their search. The speaker is obviously calm, and Poe illustrates the tone calm here perfectly while also using a simile, comparing the narrator’s calm heart to that of one whom innocently sleeps.Lastly, Poe uses irony as a way to demonstrate his theme. The speaker’s thought triumphing over the cat is a good example of irony. The day after he hanged Pluto, his first cat, his house unexpectedly burned down. He imagines seeing in the ruins the shape of a cat imprinted on a wall, a cat with a noose around its neck. It’s clearly ironic that even though he killed the cat, his overconfidence of believing he defeated it leads to the Pluto having the last laugh when the narrator’s house and all his riches burn with it.Poe illustrates another example of irony when the narrator kills his wife and believes the cat has run aw ay in fear. When the narrator hides his wife’s corpse in the wall and during the search of his home out of overconfidence taps on the wall repeatedly, a cry responds leading the police to tear down the wall and discover the corpse and also the cat. It’s ironic that in the end it was the cat that leads to the narrator’s demise after believing the cat had ran away.In conclusion, Poe portrays his theme Overconfidence can betray by using story elements such as tone, character, and irony. There are several examples throughout the story and Poe uses them effectively. Imagine the joy and overconfidence combines with the adrenaline that one must have while knowing they’re about to get away with murder. In the end the narrator just couldn’t contain all that emotion. Put yourself in that situation, do you think you could’ve maintained composure and got away with it?
